DIRECTORATE GENERAL OF RESETTLEMENT AND EMPLOYMENT NOTIFICATION NO. G.S.R. 477, DATED 26 APRIL 1960

In exercise of the powers conferred by Section 10 of the Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 (31 of 1959), the Central Government makes the following Rules:

I. Short title, extent and commencement

  • These rules may be called the Employment Exchanges (Compulsory Notification of Vacancies) Rules, 1960.
  • They shall come into force on 1st May 1960.

II. Definitions

In these Rules, unless the context otherwise requires:

  • Act means the Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959.
  • Central Employment Exchange means an Employment Exchange established by the Government of India.
  • Director means the Officer-in-charge of the Directorate administering Employment Exchanges in a State or Union Territory.
  • Form means a form appended to these Rules.
  • Local Employment Exchange means:
  1. In all of India except Chandigarh, the Employment Exchange notified by the State Government or Union Territory.
  2. In Chandigarh, the Employment Exchange established by Chandigarh Administration or Punjab/Haryana State Government.
  • Private Sector establishments.

III. Employment Exchanges to which vacancies are to be notified

Vacancies of technical/scientific posts with basic pay of Rs. 400 or more and vacancies requiring circulation outside the State shall be notified to the Central Employment Exchange.

All other vacancies shall be notified to the Local Employment Exchange.

IV. Form and manner of notification of vacancies

V. Time limit for notification of vacancies

  • Vacancies for the Local Exchange must be notified at least 15 days before the interview/test.
  • Vacancies for the Central Exchange must be notified at least 60 days in advance.
  • Selection results must be furnished to the Employment Exchange within 15 days.

VI. Submission of returns

Quarterly returns (ER-I) and biennial returns (ER-II) shall be furnished within 30 days of the due date.

VII. Officer for purposes of Section 6

The Director shall exercise rights under Section 6 or authorize a representative.

VIII. Prosecution under the Act

The Director of Employment of the State is authorized to sanction prosecutions under the Act.
